It may come as a shock to many reading this article, that this law has only just been placed in England, but FINALLY it has been officially enforced by law that it is now illegal for beauty businesses in England to supply and administer botulinum toxin (botox) and derma fillers to under 18's, if it is purely being done for cosmetic reasons. This comes out in the wake of the new Botulinum Toxin and Cosmetic Fillers (Children) Bill, which came into force on 1st October 2021.


The newly introduced bill strictly prohibits procedures of this nature from being performed on under 18’s in England if they are to be for aesthetic purposes and not approved by a doctor. Now, by law, businesses should seek proof of age. It is also the case that consent from the parents or guardians will not be enough to use as a defence.


Before this new law came into place, there was a suggestion that an estimated 70,000 people under the age of 18 actually received botulinum toxin (botox) or cosmetic fillers each year, according to the Department of Health. Programmes such as Love Island were under scrutiny and accused of making injectables desirable to under 18’s since 2019, a period where many Health Experts were calling  for the UK Government to ban injectables.


If a case were to arise where a medical need was detected and this were to be approved by a qualified doctor, procedures may be able to take place on an individual that is under 18, provided that the procedures are undertaken by registered health professionals. 


It has been suggested by The Department of Health and Social Care that if anyone were to fail to comply with the new laws this “could result in a criminal prosecution and an unlimited fine”, so it is not advisable that any aesthetician go against the law to continue now illegal procedures on anyone under the age of 18.
